Official Rules for Continental Tire: 2010 FIFA World Cup™ Sweepstakes

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

2. INTRODUCTION: Continental Tire the Americas, LLC (“Sponsor”) is offering the Continental Tire: 2010 FIFA World Cup™ Sweepstakes described in these official rules (the "Sweepstakes").
3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who as of 2/16/10 are 18 years of age or older and possess a valid, unexpired U.S. driver’s license. Employees of the Sponsor and its parents, subsidiaries, affiliated companies, dealers and agents, and the foregoing employees’ household or immediate family members (defined as parent, spouse, child, sibling or grandparent) are NOT eligible to enter the Sweepstakes.
4. TIMING: Sweepstakes begins at 8 a.m. Eastern Time ("ET") on 2/16/10 and ends at 5 p.m. ET on 3/31/10 (the "Sweepstakes Period").
5. HOW TO ENTER: Limit one entry per person. To enter: during the Sweepstakes Period visit www.continentaltire.com (click on the Sweepstakes link on the home page) and correctly complete the official entry form and submit your entry as directed (please note that all required information/fields on entry form must be fully, accurately and legibly completed or entry may be voided). Sponsor shall retain discretion as to whether a submitted entry form is appropriate for the Sweepstakes. Sponsor reserves the right to include a Sweepstakes official entry form at any additional authorized website or other authorized location.
6. GRAND PRIZE: One (1) grand prize will be awarded consisting of a 5-day/4-night trip for the grand-prize winner and a guest ("SA Guest") to Johannesburg, South Africa from 6/15/10 to 6/19/10 (the "Grand-Prize Trip"). The SA Guest must be 18 years of age or older at the time the Travel Companion Release referred to below is executed. Grand-Prize Trip includes: a) Coach class round-trip airfare for two from a major gateway airport closest to grand-prize winner's U.S. residence to Johannesburg, South Africa (grand-prize winner and SA Guest must fly together) (if connecting flight in Europe is required, departure date may be moved to 6/14/10); b) Three-nights’ lodging (double occupancy); c) Five meals for two people while in South Africa (all other meals are winner’s responsibility); d) Small safari on 6/17/10 (location, duration, date and time determined solely by Sponsor); e) Two tickets to a USA men’s soccer match on 6/18/10 in Johannesburg (ticket details determined solely by Sponsor). The grand-prize winner and the SA Guest must possess a valid and unexpired passport (or be eligible for and have made application for such passport prior to the execution of the winner documents mentioned below) that permits travel between the U.S. and South Africa throughout June, 2010, or grand-prize winner will be disqualified and forfeit any right to the said prize (in which case, said prize will be awarded to an alternate via random drawing). The total approximate retail value ("ARV") of the Grand-Prize Trip is $4,400 (actual value will vary depending on the grand-prize winner’s location and fares/rates when booked).
7. FIRST PRIZE: One (1) first prize will be awarded, consisting of a 2-day/2-night trip for the first-prize winner and a guest ("SCS Guest") to attend a 4-hour countryside tour with Supercar Sensation (“SCS”) of Charlotte, NC (the "First-Prize Trip"). The total ARV of the First-Prize Trip is $2,000 (actual value may vary depending upon location of first-prize winner and fares/rates when booked). The SCS Guest must be 18 years of age or older at the time the Travel Companion Release referred to below is executed. The first-prize winner must start the First Prize Trip by 10/22/10 at the latest or he/she may forfeit the prize and the prize may be awarded to an alternate by random drawing. The First-Prize Trip includes: a) Coach class round-trip airfare for two from a major gateway airport closest to the first-prize winner's U.S. residence to Charlotte, NC (winner and SCS Guest must fly together) ($200 cash may be awarded in lieu of airfare if winner resides within 300 miles of Charlotte); b) Two-nights’ lodging (double occupancy); c) Participation for the first-prize winner and SCS Guest in the above-mentioned 4-hour countryside tour with SCS (“SCS Tour”) (said tour normally takes place on 2nd and 4th Saturdays of each month). In order to participate in the SCS Tour, the first-prize winner and SCS Guest must: (i) provide SCS with his/her valid, unexpired U.S. driver’s license; (ii) have a clean driving record as defined by SCS on their website (www.supercarsensation.com); (iii) provide SCS with proof of his/her active U.S. automotive insurance; (iv) be able to safely drive an automobile without needing any special equipment or aides; (v) sign the SCS waiver and/or any other document(s) required by SCS; (vi) comply with the SCS driving rules as defined on their website; (vii) agree to take full responsibility for any traffic violations and fines incurred by the said winner and SCS Guest during the SCS Tour; and (viii) agree to be fully liable for and take financial responsibility for any damage or injury caused as a result of his/her participation in the SCS Tour. Failure to comply with any of the above mentioned SCS Tour requirements may result in the first-prize winner and/or SCS Guest forfeiting any right to participate in the SCS Tour with no right of substitution (in which case, participation in the SCS Tour will not be awarded).
8. SECOND PRIZES: Two (2) second prizes will be awarded each consisting of a set of four (4) tires from Continental Tire with a total ARV of up to $1,500 per winner (actual value may be less depending upon tire and size chosen).
9. PRIZES, GENERAL: The total ARV of all prizes to be awarded in the Sweepstakes is $9,400. Limit one prize per person. Each Sweepstakes prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor in the event that a prize or part thereof cannot be awarded for any reason; in such event, Sponsor will in its sole discretion award a substitute prize or part thereof of equal or greater value. Subject to the conditions herein, each prize will be awarded. Each winner is solely responsible for the following in relation to a Sweepstakes prize awarded to him/her: a) any and all applicable taxes (including but not limited to the following taxes: federal, state, local taxes and sales tax); and b) any and all applicable fees and expenses that are not specifically set forth herein as included with a Sweepstakes prize and are related to the acceptance, award, installation, enjoyment and use of a Sweepstakes prize (including but not limited to a winner’s sole responsibility where applicable for: medical insurance, liability insurance, trip insurance, property damage, bodily damage, ground transportation, personal expenses, meals, room service, telephone, gratuities, incidentals, tire installation/balancing and service fees). All details regarding a Sweepstakes trip described herein (including, but not limited to airline(s), flights, seats, hotel, room and activities will be designated solely by Sponsor and may be changed at any time at Sponsor’s sole discretion. Sponsor is awarding each Sweepstakes prize on an "AS-IS" basis without warranty, guaranty or representation of any kind express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose and usability by a winner. Visual prize depictions may not accurately represent an awarded prize.
10. RANDOM DRAWING: On or about 4/14/10 the Sweepstakes winners will be selected by random drawing from all eligible entries received. The said drawing will be conducted by an independent judging organization (“Judging Agency”), whose decisions on all matters related to the Sweepstakes shall be final and binding. A participant selected as a potential Sweepstakes winner must comply with all terms and conditions set forth in these official rules, and winning is contingent upon fulfilling all such requirements. Odds of winning depend on the total number of eligible entries received.
11. NOTIFICATION: Potential Sweepstakes winners will be notified (the "Notification") by email, mail or courier (or other method at the discretion of Sponsor) within approximately five (5) days of the above-mentioned random drawing. Within seven (7) days of the send date, postmark or shipment date of the Notification, a potential winner must return as directed each of the below-listed documents (unless determined not to be applicable by the Sponsor): a) An Affidavit, Waiver, Release and Indemnity Agreement, including where lawful a Publicity Release (prior to said return, to be correctly completed and executed by applicable potential winner); and where applicable b) A Travel Companion Release, including where lawful a Publicity Release (prior to said return, to be correctly completed and executed by applicable prize winner’s guest for applicable Sweepstakes prize trip). Where lawful all information requested of a potential winner/guest by the Sponsor must be accurately and legibly provided. Please note that additional documents may be required at the discretion of Sponsor. Failure to comply with the requirements of this paragraph (or the return of any prize or prize notification as non-deliverable) may result in disqualification and in the forfeiture of any right to a prize, in which case such prize will be awarded to an alternate by random drawing.
12. ENTRANT VERIFICATION: In the event of a dispute regarding which individual submitted any entry, such entry will be deemed submitted by the natural person whose name is on the Sweepstakes entry form.
13. RELEASE: By participating in the Sweepstakes and/or accepting a prize, a participant/winner agrees to defend, release and hold harmless the Sponsor (and where applicable a supplier of a service or product included with a Sweepstakes prize) and their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, members, managers, employees, representatives, agents and all others associated with the development and execution of the Sweepstakes (collectively the "Releasees") from and against any actions, claims and/or liability for injury, loss or damage of any kind (including any for the violation or infringement of any proprietary or personal right of any individual or entity, and any personal injury, death and/or property damage) resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes, and/or the use, enjoyment, acceptance or possession of a Sweepstakes prize, and/or participation in a Sweepstakes prize-related activity. BY PARTICIPATING IN THE SWEEPSTAKES AND/OR ACCEPTING A PRIZE, A PARTICIPANT/WINNER ACKNOWLEDGES THAT THE SWEEPSTAKES PRIZES INVOLVE ACTIVITIES THAT COULD BE DANGEROUS AND COULD INVOLVE THE RISK OF SERIOUS INJURY, DEATH AND/OR PROPERTY DAMAGE, AND FURTHER THAT PARTICIPATION IN SUCH ACTIVITIES REQUIRES AGREEMENT TO ASSUME FULL RESPONSIBILITY FOR SUCH RISK, INCLUDING ANY INJURY, DEATH OR PROPERTY DAMAGE CAUSED BY THE NEGLIGENT ACTION OF OTHERS. FAILURE TO AGREE TO ASSUME FULL RESPONSIBILITY FOR SUCH RISK MAY RESULT IN APPLICABLE WINNER FORFEITING A PRIZE AND SAID PRIZE BEING AWARDED TO AN ALTERNATE BY RANDOM DRAWING. By participating in the Sweepstakes and/or accepting a prize, a participant/winner consents to and gives the Sponsor and its representatives, licensees, assignees, parents, subsidiaries, affiliates, divisions, advertising and promotion agencies (collectively the “Licensees”): a) The right to photograph/video a winner (including an awarded Sweepstakes prize and throughout a Sweepstakes prize activity); and b) The right in perpetuity to use, reuse, publish and display a participant’s/winner’s name, address, entry form information, statements, quotes, opinions, picture, portrait, likeness, voice, video, photograph(s), biographical information, prize information, and winner-submitted entry form/photograph(s)/video/text/blog(s) (in whole or in part, as may be adapted, edited or modified, as solely determined by Licensees) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without limitation or additional consideration, unless prohibited by law. Entries will not be acknowledged or returned.
14. CONDITIONS: Participants agree that by participating in the Sweepstakes they release the Releasees from any liability in connection with: a) Entries that are ineligible as a result of being lost, late, illegible, damaged, incomplete, stolen, or misdirected; b) Any typographical or other human or technical errors in the offer or administration of the Sweepstakes, including but not limited to errors in advertising, these official rules, the selection and announcement of a winner(s), or the distribution/awarding of a Sweepstakes prize(s); and c) Any omission, interruption, deletion, defect, delay, misdirection, damage, line failure, injury, technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. If in the Judging Agency’s opinion, there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Judging Agency reserves the right to modify, or terminate the Sweepstakes in a manner deemed appropriate by the Judging Agency, at the Judging Agency’s discretion. Failure to enforce any term of these official rules shall not constitute a waiver of that provision.
15. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited or restricted.
16. WINNERS’ LIST: A winners’ list will be available by sending an SASE by 5/31/10 to: Continental Tire: 2010 FIFA World Cup™ Sweepstakes, Winners’ List, P.O. Box 459, Dana Point, CA 92629-0459.
